3. Product Specifics & Variations
3.1. Customer Responsibility The suitability of goods for any specific project or environment is the sole responsibility of the buyer. The Customer should inspect all goods prior to laying to ensure they are the correct colour, batch, and shade.
3.2. Acceptable Material Characteristics The Customer acknowledges and agrees that goods sold by the Company may be subject to one or more of the following characteristics. These are not considered faults, defects, or of unacceptable quality:
- Crazing or shade variations, which are an inherent feature of all ceramics and natural stone;
- Optical hazing or smudging, which are naturally occurring characteristics of polished porcelain goods;
- Reasonable variations in colour and veining in marble, as these are natural goods and such variations must be expected;
- Variations in sizing, weight, colour (including changes to colour over time), pattern, veining, texture, durability, density, surface, and finish.
3.3. Quantity Estimates Any estimations provided by our staff or calculators on the website are for guidance purposes only. It is the responsibility of the purchaser or their qualified installer to confirm the final quantities required.
4. Terms Of Sale & Payment
4.1. Pricing All prices quoted on our website are in Australian Dollars (AUD) and are inclusive of GST unless otherwise specified. We reserve the right to amend our prices at any time without prior notice.
4.2. Payment Full payment for goods must be received in cleared funds prior to the dispatch of any order or the collection of goods from our premises.
4.3. Pricing Errors In the event that a product is listed at an incorrect price due to a typographical or system error, we reserve the right to refuse or cancel any orders placed for that product. If payment has already been processed, we will issue a refund for the full amount.
5. Sales, Promotions & Special Orders
5.1. Non-Returnable Items Subject to the Trade Practices Act or other applicable legislation or law, no returns will be accepted on:
- Special orders;
- Custom items;
- Sale items;
- Border tiles; or
- Discontinued lines.
5.2. Sale Confirmation Because terms can vary significantly between different promotional events, you are encouraged to confirm the specific terms and conditions of any sale item from our customer support team before finalising your purchase.
6. Delivery & Inspection
6.1. Delivery Estimates Delivery dates provided are estimates only and are subject to change due to logistics. Om Floor and Tiles is not liable for any loss, damage, or costs arising from delays in delivery.
6.2. Inspection Upon Receipt (24-Hour Rule) All goods are to be checked against the invoice upon receiving. Prior to delivery, all products undergo a thorough inspection to ensure they are complete and undamaged.
- Missing Goods: We do not accept claims on missing/lost goods once received.
- Damages: Should there be any damages, you must notify us within 24 hours of receipt. After such time, your acceptance will be deemed for the items in their current condition.
6.3. Delivery Access Delivery is typically provided as a kerbside service. It is the customer’s responsibility to ensure that there is a clear, level, and safe area for the delivery driver to unload.
7. Returns, Refunds & Cancellation
7.1. Change of Mind Please choose carefully. We do not offer refunds on change of mind purchases. We are not legally required to provide a refund or replacement if you change your mind, over-order, or find the product cheaper elsewhere.
7.2. Discretionary Returns & 20% Surcharge At our absolute discretion, we may accept returns of full, unopened cartons of current stock items. Any such return, or the cancellation of ordered goods, will be subject to a 20% surcharge to cover the costs of processing, restocking, and inventory management.
7.3. Condition of Goods Goods cannot be returned if they have been opened, installed, or used.
8. Installation & Warranty
8.1. Installation Equals Acceptance It is a fundamental condition of sale that “Installation Equals Acceptance.” No claims for shade variation, calibre, or visible defects will be accepted once the product has been laid or installed.
8.2. Certified Tradespeople Requirement For the warranty to apply, Certified Wall/Floor Tilers and waterproofing professionals must be used for the installation.
8.3. Job Certification Job certification from the licensed tradesperson must be presented with any claims.
8.4. Manufacturer Warranty All goods are limited to the terms and conditions of the manufacturer’s warranty.
9. Consumer Guarantees & Liability
9.1. Australian Consumer Law Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract and to a refund for the unused portion. You are also entitled to choose a refund or replacement for major failures with goods.
9.2. Professional Advice The information we provide on this website is of a general nature only. We are not providing professional or specialist architectural or engineering advice, and you should obtain independent advice appropriate to your circumstances.
9.3. Limitation of Liability To the full extent permitted by law, our liability for breach of an implied warranty or condition will not be greater than the amount you paid to us for the specific product or service in question.
